Gatundu South MP Moses Kuria risks spending time in remand after allegedly failing to comply with an order to refrain from posting hate speech on social media.

Yesterday, the prosecution applied to have his bail terms cancelled.

The state said Kuria has not toned down his comments on social media.

Kuria was accused of posting hate comments recently, despite publicly apologising for previous hate speech.

The public apology was one of the requirements for settling the hate speech case out of court.

NCIC investigator Robert Mabera urged senior principal magistrate Enock Cherono to cancel the Sh2 million bail the politician paid to secure his release and send him to remand pending determination of the suit.

The magistrate was also informed that the case against Kuria will go to full trial because talks between him and the National Cohesion and Integration Commission have collapsed.

The MP faces charges of incitement to violence, hate speech and ethnic contempt.

He was restrained by a court on November 26 last year from making statements amounting to incitement to violence and ethnic contempt until his case is resolved.

However, on January 11, he posted content on his Facebook page referring to Bible verse Genesis 17:14, which refers to the Jewish culture of circumcision.

According to Mabera, the posting was derogatory, more so since he had previously made references to non-circumcision culture of certain communities.

“In the past, he had made references to the cultural practice in a derogatory manner to demean persons of the Luo community,” Mabera stated in an affidavit.

“The statements of the accused amount to ethic contempt.”

Kuria has several times found himself in trouble over comments on social media.

At one point, he was warned by a court after he posted a comment on his Twitter account, linking members of one community to the sporadic terrorist attacks that rocked the country last year.

NCIC asked the MP to call a press conference and publicly apologise for the comment and promise to stop posting hate comments for the case to be settled out of court.

He is now required to respond to the application made by the prosecution ahead of the hearing on March 12.
