MURANG'A: 54-year-old Man Handed Life Sentence For Defiling A 9-year-old Girl

A Kigumo court on Wednesday jailed a 54 years old man with a life imprisonment for defiling a nine year old girl.

Stephen Nguruku Wagacha was found guilty of committing the offence on May 24 last year at Mathare-ini village in Kigumo sub county, Murang’a County.

The minor had testified before the court that she had gone to visit the wife to the accused but found that she was not at home.

The minor further told resident magistrate Agneta Ogonda she had formed a habit of visiting the Mr. Wagacha's wife on a regular habit as they had become good friends.

She said on the material day however, the accused person invited her into his house and closed the door behind her, to her surprise.

She told the court that the accused person ordered her to undress and lie on the bed before forcing himself on her and that she was in a lot of pain.

“I screamed for help but no one came to help me,” said the child who lives with her grandmother.

The distraught girl told the court that the accused then warned her not to tell her ordeal to anyone.

It is only after getting home that her grandmother demanded to know why she had difficulty walking and why she was in tears.

The grandmother who also testified in court said after her granddaughter narrated her ordeal to her, she rushed her to Kigumo sub county hospital immediately for treatment.

She then reported the matter at Kigumo police station and the accused was arrested.

A medical report presented before the resident magistrate showed that the girl’s had injuries in her genitals and that her hymen had been broken.

The report also indicated that the minor had been contracted a venereal infection which was treated.

The accused however told the court that the child was working with her family to paint him in bad light.

While reading the judgment the magistrate said the prosecution had proven beyond reasonable doubt that the accused had defiled the child.

She gave the accused 14 days to appeal the sentence.
