Samburu teacher charged with defiling a 12 year old pupil acquitted

A teacher who had been charged with defilement of a 12 year-old-girl at Milimani primary school in Samburu central sub county on unknown date and time between April28, 2017 and October22, 2017 has been acquitted by a Maralal court in Samburu county due to lack of a satisfactory evidence.

While reading his judgment on Tuesday evening, Senior Resident Magistrate Abraham Gachie said that, as per the evidence on record, in his view prosecution was unable to prove the charges of defilement and committing an indecent act with a minor in the first and alternative counts respectively against the accused person Mr Dominic Bosire to the standards required in law.

“The accused person is therefore not guilty as charged and I hereby acquit him as charged in the main count and the alternative count here in pursuant to the provisions of section 215 of the criminal procedure cord,” he said.

While reading his judgment, Senior Resident Magistrate Abraham Gachie explained that the prosecution failed to prove that Mr Bosire defiled the girl and made her pregnant.

“What would have cleared doubts was a DNA examination of PW1’s child and the accused person as had been sought by the prosecution. The prosecution never availed the DNA results and the accused person stated that he was never subjected to a DNA examination,” he explained.

Gachie further said that the minor’s evidence contradicted to the one that was testified in court by a clinical officer who examined her at Samburu county referral hospital.

“Further doubts are created by the PW1’s evidence that defilement took place on 5thday after they opened the schools on August28, 2017 and again four days later. That is on September2, 2017 and September6, 2017. This evidence was contradicted by the clinical officer who gave evidence that conception took place within the month of August 2017,”

The magistrate said that the prosecution failed to prove the complainant’s age with documentary evidence in court.

“PW1 gave evidence that she was 12 years old. However no conclusive evidence was tendered to prove her age, the birth certificate was not produced as an exhibit. From the evidence on record the age of the minor is not clear,” he explained.

40-year old suspect on the run after defiling, impregnating five teenage girls

A 40-year old man in Baringo North sub-county is on the run after allegedly defiling and impregnating five teenage girls aged between 13 – 16 years.

The suspect a boda boda rider fled away after noticing he was being sought by police for doing the heinous acts between January and September last year.

“He may have been seducing the girls by offering free rides and bribing them with little money before booking illegal dates with them.” a local chief told the star on Friday.

He further noted that the unmarried man has so far been reportedly impregnated five young girls, “some of the cases have been sorted locally by the affected families” he said.

The local administrator said all the girls have had their learning suspended for a while as they remained at home to look after their new born babies while some were yet to give birth.

He said the suspect had since gone missing after slipping in the hands of police officers in a planned attempt to arrest him in November last year.

Ben Chebor (not his real name) father on one of the girls said the suspect defiled and impregnated his 16-year-old class five daughter in September last year before fleeing away.

“My daughter is now seven months pregnant, due to stigma, she has decided to stay at home as she prepares to deliver” he said.

The agitated man who spoke to media while in Kabarnet accompanying his daughter to receive medical checkup at Baringo county referral hospital appealed to the police to intensify search and get the man arrested and prosecuted.

“I have decided to allow my daughter deliver her baby then later I will get her back to school to continue her learning.” he said adding that he will not whatsoever allow anybody to disrupt him from seeking justice for her innocent child.

 

Amid adulthood age controversy

This occurs amid the brewing controversy in the National Assembly to have adulthood sexuality age reduced from 18 to 16 years in order to cut on high rate of court prosecutions on defilement cases.

The bill has so far faced criticism among majority members of parliament who opposed the age reduction saying it might end up giving liberty tender age children to engage in sexual activities which may result in massive pregnancies and school dropout.

Baringo Woman wants husband jailed for defiling daughters, infecting them with STI

A woman in Baringo North Sub-county wants her husband arrested for defiling his three daughters infecting them with Sexually Transmitted Infection (STI).

As the world celebrated women day on Friday March 8, Sally Chelimo (not her real name) is crying for justice after her three daughters aged 7 and 14 years were being raped severally by their blood father.

“This is a real beast, I want him arrested and jailed for raping my innocent daughters and denying them a good future” Chelimo told media in Kabarnet town today on Friday.

She said she did not return back to her matrimonial home after fleeing owing to a dispute that saw her beastly husband beating her almost to death in December 2018.

“He was a humble and good-looking man when I met him in 1999 before turning wild immediately after engaging in heavy alcohol drinking since 2005.” Chelimo said.

She said besides restraining her from working as a casual laborer in people’s farms in order to fend for her kids, the man who worked as a carpenter, went ahead to beat her with her children.

The suspect went ahead to restrain his children from going to school, threatening to kill them saying they should stay at home and become school dropouts like him.

She said the violent man used to return home every day late and drunk, “he starts beating us randomly in the house, I used to persevere thinking he might change but he got more worse I finally decided to flee away fearing for my life, leaving him with the care of the children” Chelimo said.

Raped

Residents led by the local chief said apart from sharing one mud-walled room the man used to share a bed with all his children including his daughters.

“It just came to our notice through tip off by the neighbours that he used to threaten to chop the girls’ necks if they dare resist his advances” the chief said.

He said since the man divorced his two previous wives he has become hostile in the community and even walks around with a panga threatening to kill every person he spots walking around or talking to her present wife.

Police are currently pursuing the suspect who fled away immediately after noticing his up evil has leaked and realizing he was being sought for arrest.

“He will run but not hide, we will catch up with him to face the full force of the law” Baringo North OCPD Chemongis Ndiema said.

Medical checkup

However Kabartonjo hospital senior clinical officer Sammy Kirwok said all the three girls had bruises owing to forceful penetration into their private parts and were all infected with an STI, which is uncommon in children.

“The elder one had her hymen totally broken although she tested negative for pregnancy” Kirwok said adding that they have all been treated.

 

Veterinary officer, 58, arraigned in court for defiling, impregnating 14-year old girl

58-year old veterinary officer was today arraigned before Kabarnet law court, Baringo County for allegedly defiling and impregnating a 14-year old class seven girl.

 

The accused Solomon Cherutich reportedly did the heinous act to the minor at Kapartai village in Aiyebo Sub-location, Baringo North Sub-County between 2nd and 9th September 2017.

 

“I am a farmer so I used to invite him (the accused) to my home to come and sire my cows with Artificial Insemination(AI), I trusted him as an old man, little did I know he was planning evil against my young daughter” the minor’s  father Kenneth Chemelil told media outside the court.

 

Chemelil said his daughter is mentally disturbed because she is yet to resume her learning after giving birth on May last year.

 

“While she was pregnant she would only cry when we interrogated her to reveal the owner, but until recently after giving birth is when she named the culprit” Chemelil said.

 

The accused who appeared before Kabarnet Senior Resident Magistrate Nerolyne Idagwa pleaded not guilty and was granted a Sh200,000 bond.

 

If found guilty, the accused shall face charges contrary to section 8(1) as read with 8(2) of the sexual offenses act 3 of 2006.

 

The accused was arrested by police on Thursday at his Tirimionin home after the girl’s parents informed the County children’s department.

 

The bitter father now calls for justice saying “I really care educating my children so that they would come and assist me during my old age but I am not happy when someone does something terrible like this to them” he said.

 

However the case will be mentioned on January 23 pending hearing18 February 2019.

27 year old man arrested for defiling a 16 year old girl in Maralal

Police in Maralal Samburu county have arrested a 27 year old man after he allegedly defiled a sixteen year old girl for three days.
Patrick Chege was arrested on Thursday after his neighbors became suspicious about his relationship with the minor and alerted nyumba kumi and the area chief.
According to a neighbor, the minor who is expected to join form one next year has been living with Chege for the last three days at his shop in shabaa area in the outskirts of Maralal town.
Area chief Selina Lemakara has cautioned men in samburu county to keep off school girls while looking for wives saying that their education comes first.
At the same time she called on parents to stop treating girls who have finished class eight as adults adding that under the law they are still children who are in need of care and protection.
“Many parents in samburu still think that if their children sit for KCPE they automatically become adults who can be married off or left alone to fend for themselves.” She said.
 The minor’s sister mentioned that they have rented in the same compound with the 27 year old man who might have enticed her with ‘ngumu’ a local breakfast delicacy which he prepares in his house and sells to shopkeepers.
The offender will be arraigned in court once investigations are done.

Baringo North family whose 9-year old daughter was defiled cries for justice

A 24-year old suspect is still free after allegedly defiling a 9-year old standard three girl in a rural village in Baringo North Sub-county last Saturday.

Addressing media in Kabarnet town on Wednesday, area local chief said the suspect is yet to be handed an arrest warrant.

“Yes, he is still at home despite earlier push for his arrest… after going through the medical report, police in Kabartonjo found the young girl’s health on stable condition and were reluctant in arresting.” Chief said.

The suspect who dropped out of primary school two years ago is currently known for terrorize young girls in the village.

“I helped in arresting the suspect last year and handed him to the police over a similar act he did to another minor, but the family intervened by requesting the matter be handled at home” Chief said adding that he has repeated it again.

According to statement, her mother had sent the girl around 12 pm to pick her young brother from a nearby private school on June 9.

The suspect [known to her] reportedly met the girl on the way before dragging her into a nearby forest, about 200 metres from her home, defiling her before running away.

“But due to her fear and discomfort she reported the matter to her mother on Monday 11” The father told media in Kabarnet town on Tuesday.

He said his daughter has since then been sick at home such that she could not be able to walk to school.

The girl was then rushed to Kabartonjo Sub-county Hospital for check up and later referred to Baringo County Referral Hospital in Kabarnet town.

Doctors report read; [the child health condition is fair after claiming to have been defiled by a person known to her on the way while collecting her young brother in school].

“Even after presenting to them the medical examination report proving that my daughter was defiled, police is yet to arrest the suspect” heartbroken father said.

However, Baringo North Criminal Investigative Officer (CID) officer Andolo Munga said he just heard of the case and he will act faster to investigate it before arresting the suspect.

The family is now crying for justice calling upon the relevant authorities to take up the matter and have the suspect convicted.

Addressing the media in sideline after attending Day of African Child on Tuesday, Baringo County Director Children Services Omuse accused the Sub-County police Criminal Investigative Department for laxity saying the suspect ought to have been arrested.

Father Of Six Arrested For Allegedly Defiling His Two Daughters For A Period Of Three Years

A father of six has been arrested in Kinangop for allegedly sexually abusing his two daughters for a period of three years.

The farmer who is been held in Ndunyu Njeru police station was arrested on Monday in his home in Mikaro village following a tip off by some family members.

This came as details emerged that the suspect would threaten the minors with unspecified action if they told anyone what was going on at home.

According to a resident Simon Muraya, the minors had on several occasions complained to classmates at school of the ordeal they were going through at home with little assistance.

Muraya said in the recent incidence, the two complained and when the teachers found out and reported the matter, the suspect transferred them to another school warning them with dire consequences if they reported again.

“They have been living in fear for that long but his proverbial days have come and he will have to spend the next part of life in jail,” he said.

Muraya noted that cases of sexual harassment among school going children in the area was rife with close relatives being part of the abuse.

Area chief Magdalene Kariuki confirmed the incidence saying the suspect was being held at Ndunyu Ndunyu police station and will be arraigned in court once investigations are through.

“The two minors have been taken to hospital where tests will be conducted to ascertain whether they were abused before the suspect is taken to court,” she said.

Meanwhile shock and disbelief gripped residents of a Naivasha estate after a new born baby was found dumped by the road side in the area.

Residents heading to work in the morning found the baby near the Naivasha law courts with many questioning the motive.

According to a resident Magdalene Wanja, the residents were alerted by screams from the infant who was hidden in a bag and on checking found she was alive.

She said that there were indications that the suspect gave birth on the scene before leaving the minor and fleeing to unknown place.

“We took the minor Naivasha sub county hospital where he is recuperating and we are asking members of the public to report any woman who may have delivered but does not have the baby,” she said.

Police Holding A Pastor Accused Of Defiling A Girl In His Church

The police are investigating an operator of a children’s home who has been accused of sexually exploiting an 18 year-old woman.

The middle aged man who is also a pastor is accused of taking advantage of the girl who comes from a poor home and was seeking school fees to join a boarding school from a day secondary school.

It is said the pastor visited the girl’s home in December and asked her mother to allow her to visit the children home saying he would help her access bursary.

Explaining her ordeal, the girl narrated how the pastor forced her to have sexual intercourse inside his church and at the children’s home numerous times.

The girl noted that she had lived in the home when she was 6 years old but left after the pastor starting making sexual advances four years later.

“He took advantage of my poverty to abuse me and did not help me,” she said.

Her mother said the girl went to the children’s home on December 23 and stayed there for several days after the pastor pledged to help her join a boarding secondary school.

After she came back, the mother said, she explained what had transpired, saying it is unfortunate that the pastor had taken advantage of their poor state to exploit her daughter.

” I have really struggled to raise my five children since the death of my husband as a casual labourer. I keep asking myself why the pastor chose to do that to my fourth born daughter,” she added.

Kangema Sub County Children Officer and area Deputy County Commissioner (DCC) confirmed having recieved the complaints as well as the area chief.

The Children Officer Charles Maina said investigations have been launched into the matter saying it is sensitive considering the pastor has other children under his care.

He offered to provide protection to the victim saying if the allegations are confirmed to be true, the children’s home will be closed down and alternative shelter sought for the children.

Huu Ni Unyama: HIV positive Man Rapes A Three-year-old Girl

A man has been arrested for defiling a three-year-old girl in Bahati, Nakuru county.

Dominic Mathenge, said to be HIV positive, reportedly enticed the girl with sweets before defiling her.

The girl’s mother said she learned about it on Saturday and took her daughter to hospital where doctors found that she had been defiled several times.

“I was shocked when my daughter told me she has been defiled by Mathenge,” the mother said.

Mwangi Mbogo, a village elder, said Mathenge is abusive and an alcoholic.

He said the suspect has been arrested several times and released.

Area OCPD Edward Wafula said Mathenge will be arraigned on Friday.

In a related incident, a man was arrested in Kitengela for raping the daughter of a woman he was cohabiting with.

The suspect, a mason in Kimalat area, is said to have threatened the victim with a knife during the incident.
