The burial of former nominated MP Mark Too will  go on as planned  by his family members after a woman who sought to halt the internement withdrew her case.

Senior lawyers Professor Tom Ojienda and Danstan Omari  told  judge Justice  Aggrey Mmuchelule that family members have agreed that the son of Fatuma Hassan will participate in the funeral arrangements.

The woman's grievances were accepted by the two wives of the deceased and the funeral arrangement will go on as planned in Eldoret.

Fatuma Ramadhan Hassan, had claimed that a child whom she sired with late Too was excluded from the burial arrangements.

The aggrieved mother, through her lawyer, told the court that the family of the late politician had made arrangement to bury the body on  9th January without the involvement of the minor whom the deceased supported in his education and social life.

The lawyer said that it's in the best interest of justice, that the larger family include the minor in the burial arrangement. The teenager is currently a Form Four student at a secondary school in Nairobi.

The deceased passed away on the 31st of December 2016 at Nairobi Hospital while undergoing treatment.

 The judge said that DNA results showed that the minor was born by the late politician and it's important that other family members should recognize the minor.

The mother sued the two wives of the deceased, Mary Too, and  Sofi Too, whom she accused of excluding her son from other family members in the burial program.
