High Court Declines To Compel Millie Odhiambo To Apologise To President Kenyatta

The High court has declined to issue interim orders compelling Mbita Mp Millie Odhiambo to apologize to President Uhuru Kenyatta and the people of  Kenya over her utterances made towards the President in Parliament last year.

Justice John Mativo instead said it was prudent to give both parties more time to respond and to hear all parties.

"Accordingly I find that this is not a proper case to grant interim orders as sought." He ruled.

Philip Njuguna Waruthi wanted the MP compelled to issue an apology to the Kenyan people in a manner and terms approved by the court though mass media over the alleged remarks.

The court also declined to stop the Mp, her agents, servants or otherwise restrained from uttering derogative words which demean President Kenyatta.

Through lawyer Harrison Kinyanjui, he had argued that Millie Odhiambo was bound to uphold, protect and defend the Constitution but she has not done so.

Waruthi,who is an aspirant for the Kandara parliamentary seat, argued that the MP violated her parliamentary privilege and immunity and such is not available to her defence.

Justice Mativo asked the Attorney General and Millie Odhiambo to file and serve their responses and appear in Court on January 24th.

He accused the MP of belittling and insulting the Presidency in flagrant violation of Article 131(1) (e) of the Constitution which cites the President as the symbol of unity.
