A 47 year-old man has been charged for defiling his 10 year old daughter.

George Odhiambo Oyoo allegedly defiled his daughter at riverside estate in Ruaraka on diverse dates between March and May 3.

According to the police covering report, the incidence was discovered by the girl’s class teacher who saw her uniform with blood at the back area.

She asked her why she was bleeding but the girl refused to open up until May 30, 2017 when the teacher told the father to buy sanitary towels for his daughter.

However, the father told the teacher that the child was of tender age and she was yet to receive her period.

This prompted the teacher to inquire from the child what was happening and that was when she explained that her father had been continuously defiling her from March after her sister left for the rural home leaving her with the father.

The class teacher informed her workmate who proceeded with the child to report the matter at Ruaraka Police station.

The 10 year old told the police that her father has been defiling her at night by removing her inner wear and threatened her not to report to anyone.

“The child’s behavior had changed which was noticed by the class teacher and church members. They noted that she is always sad and silent which was unlike her since they knew her,” read the report.

According to the police report, she was taken to the hospital where she was confirmed to having being defiled. This led to the father being arrested.

“The investigations have confirmed that the child had reported the incident to the uncle who did nothing to help her. This is why she opened up to the class teacher,” read the report.

Oyoo appeared before Nairobi Principal Magistrate Kenneth Cheruiyot and denied the charge.

Director of Public Prosecution opposed his release on bail until the victim who is his child testifies in the case.

“Releasing the accused person on bail will jeopardize the case since the complainant is his daughter,” said prosecution counsel Willy Momanyi.

Oyoo pleaded with the court to release him on bail claiming he was the soul breadwinner for his two other children who were in high school.

He said he needed to pay school fees for them as they depended on him for upkeep after his two wives died.

“One of my wife died while giving birth to my daughter who is the complainant in the case,” he told the court.

Magistrate Cheruiyot however denied him bond noting that the complainant was a child whose rights must be taken into consideration. He further directed that he be escorted for medical examination.

The case will be heard on July 12 and mentioned on June 19.
