A Kangema court on Friday sentenced a 32 years old man to a prison term of 94 years after he was found guilty of raping his 94 years old grandmother.

Samuel Thiong’o Mbaria was found guilty of committing the heinous act on October 11, 2016 at Gacharage-ini village in Mathioya sub county.

Thiong’o was last week sentenced to life imprisonment after he was convicted of defiling a two years old girl a few hours before raping his grandmother by another magistrate’s court in Kangema.

While issuing the judgment, senior resident magistrate Dennis Kivuti said the prosecution had proven beyond reasonable doubt that the accused person committed the offence.

He said the elderly woman was raped at around 7.30pm just an hour after Thiong’o had defiled the minor.

The magistrate noted that the victim was unable to testify in the case as the incidence left her severely traumatized.

One of the witnesses, a Form-2 boy who is a grandson to the complainant told the court that he was alerted by her screams on the material day, only to find her house locked from the inside.

When he peeped through the window, the boy said he saw the accused lying on his grandmother and that she was screaming for help.

He told the court that he also started screaming, attracting the attention of villagers led by his mother, who also testified in the case.

When the crowd broke into the house, they found both the granny and the accused person naked, with the granny unconscious.

Witnesses told the court that locals wanted to lynch the accused person were it not for the efforts of the local assistant chief who pleaded with them not to.

A medical report done at Kangema sub county hospital where the granny was taken for treatment confirmed that she had virginal penetration.

“On the same day, the accused person was accused and convicted of defiling a minor in the same village. He took advantage of his grandmother’s vulnerability to assault her,” the magistrate said.

He added that the accused was found at the scene of crime and arrested, dismissing his defense that he is mentally handicapped.

The accused person, the magistrate added is a dangerous sexual offender and should not be allowed to live among other members of the society.
